My complaint is with Lyle Ludwig, the attorney who contacted me via the USPS stating he is sueing the nursing home that my husband was in for neglect. Months later I was notified by CMS that a claim was settled and they were getting a chunk of the settlement. I the attorney Ludwig who was listed on the letter and made arrangements to meet with him to discuss. Nicely he explained what he felt happened at the nursing home, the amount of the settlement, the possibility of another big settlement that is in progress, how this current settlement would be distributed and who would receive the settlement. He brought out paperwork for me to sign and my husband’s niece was the executor of his estate that was on the paperwork. I stated that that wasn’t true, I was the executor of his estate and provided his Last Will and Testament. He tried to convince me that I should leave things as is. I reminded him that I remembered the letter that I received from him; I remembered me calling him on the cellphone listing on the letter, him explaining that he had a lawsuit against the facility that my husband was in but he never contacted me again as he said that he would. Long story short, we went back and forth about me refusing to sign off on any paperwork that I was not the only person who was the executor of my husband’s estate; we were married 27 years with him being in the nursing home his last 5 years. I visited him very regularly, washed his clothes, feed him regularly and provided foods for the staff as a gift for their kindness.
Kyle did not like my attitude towards my demands to change the paperwork, he took thing personal when I told him that he wasn’t working for me, that he was working for the niece who never mentioned a mumbling word to me about the lawsuit or the settlement. He drug this distribution out to what seemed like over a year before he finally gave me $17,450 of a $100,000.00 settlement check! He had always said that the niece was entitled to the settlement because she filed the claim. If it wasn’t for CMS sending me the letter stating their claim in the estate I wouldn’t have known anything about it and the niece would have received it all because he had her listed as the executor of the estate and she hadn’t said anything to this day to me about it! As a punishment to me he stretched things out as far as he could, paid me the least amount that he could legally get away with, asked me to sign off that the settlement check was the last of any legal dealings with my husband’s estate, in which I refused to sign. Approximately a month or so later I received a letter signed by a judge (the letter had a judge’s name but no real signature) stating that the I approved that all and any legal dealings were over. I never signed anything stating such, releasing me from the bigger settlement that he mentioned during our first physical meeting. He later stated that the the original amount of the settlement changed to a lesser amount, he didn’t know that I was the wife, and it was the niece’s responsibility to notify me of the lawsuit. I don’t and didn’t trust him throughout the entire ordeal and I tried contacting the judge to tell her that I didn’t sign off on anything but she nor her office has returned my calls. I’m a senior citizen and am so exhausted from this but I recommend that when looking for an attorney, Kyle Ludwig is not mature enough, professional enough or honest enough to handle any of my legal matters.
