The smartest decision I made was to retain Kevin O’Brien and his firm, which also includes Attorney Adam Eggleston and their firm’s Administrator/Paralegal Taylor Kaun. They are an incredible team, who work seamlessly together as a professional and highly effective unit. There is always an open communications channel for a client and your questions and requests are always addressed in a timely manner. Seemingly, in the society and culture we live in today anyone can literally accuse someone of anything, with little or no evidence whatsoever, and get away with it. The majority of time, law enforcement fails to perform a competent or thorough investigation and often times merely performs a perfunctory and limited investigation of the matter and accusations. Complaints (either felony or misdemeanor) are prepared by law enforcement, with very generic and vanilla supporting affidavits, and subsequent arrest warrants are prepared, issued, and acted upon. An arrest, most of the time, will occur quickly and an individual immediately becomes fully aware they are now a defendant and, consequently is subjected to a very uncomfortable, embarrassing, and potentially dangerous predicament. Once the individual is arraigned before the court, he immediately realizes everyone involved from law enforcement, the court, the assistant DA, and most defense counsel, all believe he is guilty. In fact, in today’s world there is absolutely no “presumption of innocence” whatsoever from anyone. A first-time defendant is in a total state of shock and is absolutely clueless as to what to do and how to proceed. A prior defendant/offender realizes from having a prior experience or experiences that if he is unable to obtain competent and aggressive “retained” defense counsel, he will be railroaded by the system and will have to hope and pray for jail time, but most likely will be sentenced to prison time and the cycle will continue once again for him. Whether it is a novice defendant or an experienced defendant, he has now entered the industrial criminal justice system complex and its convoluted and overwhelming process, which ultimately, usually forces the majority of defendants to actually lie and commit perjury on the record before the court in order to obtain a plea agreement. It is literally all planned and orchestrated by the participants within the system. If a defendant decides to proceed to trial and ends up losing his trial, he will be punished by the court and the DA’s office for invoking his constitutional right to a trial. Unfortunately, this is how our system works in this state and throughout the country. In reality, there is typically no justice in the criminal justice system for most individuals. There is only “justice for just us”, and the majority of people are not in the realm of “just us”. Based upon my own experience, and in my opinion, it is imperative for a defendant to contact Kevin O’Brien or Adam Eggleston.
